This Agreement contains the complete terms and conditions that apply to the purchase of the products described on this site. As used in this Agreement "3M" means 3M Australia Pty Limited, "PRODUCT(S)" means the product(s) described on this site (www.shop3m.com.au) and listed on the order form, and "BUYER" means the person ordering the PRODUCT(S).

These terms and conditions are applicable for PRODUCT(S) you purchase today through this site (Shop3M.com.au), and may be different from the terms and conditions of purchase for other product(s) you purchase from 3M through other websites-therefore, please carefully review these terms and conditions before purchase.

Superseding Effect

These terms and conditions apply to all 3M business transactions conducted via this (Shop3M.com.au). To the extent these terms and conditions of sale differ from those outlined in other agreements with 3M, including distributor agreements, these terms and conditions shall control.

Purchases on Shop3M Australia

Purchases on the online store may be made by credit card, and only via online entry. The (Shop3M.com.au) does not currently support EDI or system-to-system transactions. Terms of payment are governed by the customer's agreement with the applicable credit card issuer.

Products Available

PRODUCT(S) may be added or removed from (Shop3M.com.au) at any time without advance notice. The offer of PRODUCT(S) for online sale in no way commits 3M to continue to offer the same item(s) or format for sale in the future.

Products for Buyer Use or Consumption Only

Shop3m.com.au provides a BUYER with convenient on-line access to small quantities of a variety of PRODUCTS. It is intended that BUYER is purchasing PRODUCT(S) for its own evaluation, use or consumption only. BUYER may not resell, distribute or transfer as part of commercial activity the PRODUCT(S) purchased on shop3M.com.au to any third party. The PRODUCT(S) offered through shop3M.com.au are intended for sale and use in Australia only.

3M Right To Limit Quantities Or Decline Sale

3M reserves the right to limit sale or quantities of PRODUCT(S) available through shop3m.com.au. 3M reserves the right to exercise its discretion to decline sale of any PRODUCT(S), to a prospective purchaser. If 3M rejects the order, then 3M will notify the BUYER the order has been rejected.

Transportation Policy

PRODUCT(S) may be ordered from and for use in Australia only. PRODUCT(S) purchased on shop3m.com.au will be delivered via ground freight. Orders will have a standard charge added to them, depending on the total price of PRODUCT(S) ordered.

e-Communications to Distributors

Some PRODUCTS may be available from authorised distributors throughout Australia. Unless you request otherwise, we will share your needs with an authorised distributor who may be able to service future orders with quantity pricing or delivery from local stock. Over/Under Shipping Policy

For make-to-order/custom size items, it is 3M's policy to consider an order complete if 3M ships a quantity that is within 10% of the original quantity ordered.

Product Use

Many factors beyond 3M's control can affect the use and performance of a PRODUCT(S) in a particular application, including the conditions under which the product is used and the time and environmental conditions under which the PRODUCT(S) is expected to perform. Since these factors are uniquely within the BUYER's knowledge and control, it is essential that the BUYER evaluate the PRODUCT(S) to determine whether it is fit for a particular purpose and suitable for the BUYER's method of application.

Warranty and Limited Remedy

The PRODUCT(S) will meet 3M's or the manufacturer's specifications for PRODUCT(S) at the time of shipment. 3M MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. If a PRODUCT(S) is defective, BUYER's exclusive remedy and 3M's sole obligation shall be, at 3M's option, to replace the PRODUCT(S) or refund the purchase price.

Limitation of Liability

Return of Merchandise:

a.     In order to determine allowable return good eligibility, the timing of the eligibility is calculated between the 3M Ship Date and the Return Date. 3M Ship Date is the date the PRODUCT(S) shipped from 3M to the customer. Return Date is the date the PRODUCT(S) is physically received by 3M or a 3M authorized agency.

b.     Return of merchandise will be considered based on the reason for the return and the conditions below:

1.     All returns must be pre-authorised by 3M. To obtain a Return of Merchandise authorisation number, please click and complete this form.  Refer to the return’s procedure below for further details.

2.     Only PRODUCT(S) in original containers and in saleable condition, will be considered for return. 3M reserves the right to judge saleability. The shelf life of adhesive products will determine saleability. PRODUCT(S) received in unsaleable condition, in 3M's sole determination, will be destroyed with no credit issued.

3.     Credit will be issued by the 3M upon 3M's receipt of authorised goods being returned in saleable condition. A credit will be issued based on invoice value at the time of purchase, net of and terms allowed.

A. Product Quality Failure	100% credit, through complaint handling system, will be issued upon receipt of PRODUCT(S) if shop3M ticket is raised within 14 days of 3M ship date. Freight paid by 3M.
B. Damaged Material	100% credit or replacement of damaged PRODUCT(S) if shop3M ticket is raised within 14 days of 3M ship date. Freight paid by 3M.
C. Shipping Shortages	100% credit or replacement of missing PRODUCT(S), with proof of delivery to the shop3M.com.au Customer Service Representative within 30 days after 3M ship date if Shop3M ticket is raised within 14 days of 3M ship date. Note the Over/Under Shipping Policy.
D. Shipping Overages Returns	100% credit of returned PRODUCT(S) will be issued if Customer Service Representative is notified within 14 days of 3M ship date. Freight paid by 3M. Note the Over/Under Shipping Policy.
E. 3M Error	100% Credit. Freight Paid by 3M

Return Procedure

All goods to be returned, whether defective or not, will require a Return Authorisation Number before they can be returned.

You will need to supply the following information, most of which will be on your packing slip or invoice before we can issue a Return Authorisation Number: -

A copy of the original packing slip or invoice

Our reference number

Part number of product to be returned

Date on packing slip or invoice

Reason for return

Your name and contact details.

Each Return Authorisation Number is only valid for one (1) product and must match the product authorised for return.

 

Return Authorisation Numbers are only valid for 7 days, so we must receive the returned product into our warehouse within this period; otherwise, the return may not be accepted.

 

It is the customer's responsibility to ensure that all products are suitably packaged in order to prevent damage during return shipping. The customer must not write on or attach labels to the product being returned; otherwise, the return may not be accepted.

Processing Credits/Refunds

A credit note will normally be issued within 7 days of us receiving the goods returned in accordance with this Returns Policy, with the exception of goods that are not obviously faulty and may require testing.

Where a product is returned because you believe it is faulty and the fault cannot be observed by our internal testing, the product may need to be tested by the manufacturer. In such cases, the testing process may result in delays of up to 28 days before we can determine whether a credit note will be issued.

 

We will only issue refunds on request. For your security, all refunds will be made by applying a credit against the credit card used for the original purchase.

 

In some circumstances, we may elect that a replacement product or repair is sufficient remedy instead of a full refund. This election will be at our sole discretion, but will only occur after consultation with you. If we elect to have a product replaced or repaired, we will do this at our cost and return the product (or its replacement) to you promptly; in these circumstances, we will still refund your freight costs.

To the extent permitted by law, 3M will not be liable for any loss or damage arising from the PRODUCT(S), whether direct, indirect, special, incidental or consequential, regardless of the legal theory asserted, including warranty, contract, negligence or strict liability.

Controlling Laws This Agreement will be construed and interpreted in accordance with the laws of the New South Wales, Australia.

Entire Agreement This Agreement constitutes the entire agreement between the parties relating to the subject matter of the Agreement and supersedes all prior agreements, whether written or oral and all other communications between the parties relating to the subject matter of this Agreement.

Modification of Agreement

This agreement may be amended from time to time by 3M at it's discretion.

Acceptance of Agreement by BUYER
